Postcards.ai Acceptable Use Policy

This Acceptable Use Policy is incorporated by reference into the Customer Terms that link to this page. This Acceptable Use Policy applies to the Services and to the Dashboard, Platform, and related tools made available to facilitate the Services. For purposes of applying this Acceptable Use Policy, restrictions on use of the Services apply equally to Customer's use of the Dashboard, Platform, and related tools. This Acceptable Use Policy controls in the event of any conflict with the remainder of the Customer Terms regarding acceptable use.
Postcards.ai may update this Acceptable Use Policy with reasonable notice to Customer.
(a) Technical Restrictions
Customer will not engage in any prohibited technical activity, including:
- copying, distributing, disclosing, scraping, crawling, or harvesting any part of the Services except as expressly permitted;
- using robots, spiders, offline readers, scrapers, or other automated systems to access the Services in a manner that sends more request messages than a human could reasonably produce or that otherwise burdens the Services;
- transmitting spam, chain letters, or unsolicited bulk messages through the Services;
- attempting to interfere with, compromise, or decipher transmissions to or from the servers running the Services;
- taking any action that imposes or may impose an unreasonable or disproportionately large load on the Services or related infrastructure;
- uploading, transmitting, or distributing malware, viruses, worms, harmful code, or destructive files;
- attempting to gain unauthorized access to the Services, accounts, data, systems, or networks;
- bypassing measures used to prevent or restrict access to the Services;
- probing, scanning, or testing vulnerabilities except as expressly authorized in writing;
- using the Services for benchmarking, competitive analysis, or development of competing products or services;
- removing, obscuring, or altering proprietary notices;
- using any audiovisual content available on the Services except through permitted real-time streaming or other functionality expressly provided by the Services; or
- using the Services in any manner that may damage, disable, overburden, impair, or interfere with any other party's use of the Services.
"Streaming" means contemporaneous digital transmission of audiovisual content from the Services to an Authorized User's device for real-time viewing, where the data is not intended to be copied, stored, permanently downloaded, or redistributed.
(b) Customer Content Restrictions
Customer is solely responsible for Customer Content submitted in connection with the Services or made available to Postcards.ai representatives. Customer will not submit Customer Content that:
- creates risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to any person;
- creates risk of damage to property;
- seeks to harm or exploit children;
- violates or encourages violation of law, contract, or third-party rights;
- contains unlawful, harmful, abusive, harassing, defamatory, hateful, discriminatory, obscene, pornographic, violent, or otherwise objectionable material;
- infringes, misappropriates, or violates intellectual property, privacy, publicity, or other rights;
- contains false, deceptive, misleading, fraudulent, or manipulative claims;
- impersonates another person or entity or misrepresents identity, affiliation, authorization, endorsement, source, or sponsorship;
- includes malware, malicious code, or harmful files;
- includes sensitive personal information except as expressly approved in writing by Postcards.ai;
- violates postal requirements, print-provider requirements, data-provider requirements, platform rules, or industry standards; or
- otherwise violates the Agreement.
Customer represents that Customer Content does not and will not violate third-party rights. If Customer Content includes music, images, fonts, marks, likenesses, testimonials, endorsements, or third-party creative assets, Customer represents that it owns or has obtained all rights necessary for the intended use, including printing, mailing, public display, reproduction, modification, and distribution.
(c) Responsibilities for Customer Content
Postcards.ai is not responsible for Customer Content or for how Customer or its Authorized Users use the Services to store, process, generate, or distribute Customer Content. Customer is solely responsible for:
- providing notices and obtaining consents required from Authorized Users, customers, prospects, recipients, and other individuals;
- ensuring Customer Content and Customer Data may lawfully be collected, used, processed, transferred, printed, mailed, and disclosed through the Services;
- reviewing and approving all mail pieces, designs, copy, offers, disclosures, calls to action, audiences, and campaign settings before submission;
- maintaining suppression lists and honoring opt-outs, deletion requests, unsubscribe requests, do-not-contact requests, and other consumer choices;
- ensuring Customer's privacy policies and public notices accurately describe Customer's use of the Services;
- ensuring all claims, testimonials, endorsements, offers, promotions, and disclosures are accurate, substantiated, and legally compliant; and
- ensuring Customer's use of AI Features and outputs complies with the Agreement and applicable law.
(d) Advertising and Marketing Restrictions
Customer will comply with all applicable laws, regulations, industry guidelines, and self-regulatory standards regarding consumer notice and choice about marketing, advertising, online advertising, direct mail, email, SMS, telemarketing, privacy, data protection, and consumer protection.
Without limiting the foregoing, Customer is solely responsible for compliance with laws and rules relating to marketing, privacy, and advertising activities, including CAN-SPAM, TCPA, the Telemarketing Sales Rule, do-not-call requirements, FTC advertising guidance, state consumer protection laws, state privacy laws, and industry guidelines from organizations such as the Association of National Advertisers, Digital Advertising Alliance, Network Advertising Initiative, Mobile Marketing Association, Federal Communications Commission, Interactive Advertising Bureau, and similar bodies.
Customer may not attempt to merge data obtained through certain Services with Customer Personal Data, or re-identify individuals, except where permitted by law, the Agreement, the DPA, the Third-Party Provider Terms, provider requirements, and all required notices and opt-in consents.
All advertising and promotional material used or distributed in connection with the Services must comply with applicable law and industry standards, including rules and guidance regarding truth in advertising, endorsements and testimonials, health claims, dietary supplements, financial claims, sweepstakes, regulated products, and consumer disclosures.
Customer is solely responsible for the content, placement, timing, frequency, audience, and legal sufficiency of each marketing communication. Customer must maintain evidence of required consents, substantiation for claims, opt-out handling, and compliance with applicable consumer-choice requirements. If Customer uses information obtained through the Services for advertising or marketing, Customer must use it only as permitted by the Agreement and applicable law.
(e) Marketing Restrictions
Customer must obtain Postcards.ai's prior written approval before using the Services for campaigns, data, targeting, or offers:
- based on known or inferred information about prescription medications, health conditions, medical treatments, insurance status, or precise location;
- involving healthcare, medical, pharmaceutical, wellness, financial services, lending, credit, debt relief, insurance, investment, tax, banking, legal services, housing, real estate, employment, recruiting, political, cannabis, CBD, THC, tobacco, nicotine, alcohol, gambling, sweepstakes, adult content, weapons, or other regulated or sensitive products or services;
- targeted to minors under 18;
- involving sensitive personal information or special categories of personal data;
- involving eligibility determinations for credit, employment, insurance, housing, education, government benefits, or similar purposes; or
- that Postcards.ai determines creates elevated legal, provider, privacy, postal, operational, or reputational risk.
Approval may be conditioned on additional terms, disclosures, documentation, proofing, review, suppression, or other controls. Postcards.ai may revoke approval if it determines the use case creates risk or violates the Agreement.
(f) Prohibited Content
Customer may not use the Services for content or campaigns that:
- are unlawful, fraudulent, deceptive, misleading, or unfair;
- promote illegal products, services, or transactions;
- promote hate, harassment, violence, self-harm, exploitation, or discrimination;
- contain sexually explicit material or adult services unless expressly approved in writing;
- falsely imply government, postal, carrier, lender, insurer, healthcare, legal, or other official status;
- falsely imply urgency, debt, legal obligation, prize, employment opportunity, government benefit, or recipient-specific entitlement;
- include fake invoices, fake checks, fake notices, or mailers likely to confuse recipients about source or purpose;
- include unsupported claims, including health, financial, performance, environmental, or earnings claims;
- violate postal, print, provider, data-owner, or platform requirements; or
- otherwise violate the Agreement.
(g) Medical Claims
Customer may not use the Services for medical, health, pharmaceutical, supplement, treatment, diagnosis, disease, insurance, or healthcare claims without prior written approval from Postcards.ai. Customer is solely responsible for ensuring that any approved health-related campaign complies with applicable law, includes required disclosures, is substantiated by competent and reliable evidence, and does not involve protected health information unless Postcards.ai has expressly agreed in writing and the parties have entered into any required additional agreement.
Health, wellness, supplement, weight-loss, cosmetic, therapeutic, or similar claims must be truthful, non-misleading, appropriately qualified, and supported by competent and reliable evidence. Postcards.ai may require substantiation, legal review, modified copy, disclaimers, or additional approvals before processing such campaigns.
(h) Updates
Postcards.ai may update this Acceptable Use Policy with reasonable notice to Customer. Continued use of the Services after the updated policy becomes effective constitutes acceptance of the updated policy.
